These Terms of Use (“Terms”) govern your use of vcfus.com (the “site”), which is operated by Velo Capital Funding (“Velo,” “we,” “us” or “our”). By using the site, you agree to these Terms. If you don’t agree, please don’t use the site.
1. Who Can Use the Site
The site is for people in the United States who are looking into financing for a business, and for people who refer those businesses to us. You must be at least 18. If you submit information for a business, you confirm that you’re authorized to act for it.
2. What the Site Is, and What It Isn’t
The site gives general information about Velo and the financing options available through the lenders and funders we work with. Nothing on the site is an offer, a commitment to fund or a statement that any business will be approved.
The terms of any funding are set only in a written agreement you sign with the lender or funder, after you receive the cost disclosure your state requires. If anything on the site differs from your disclosure or agreement, the disclosure and agreement control.
All financing is for business purposes only and is subject to application, review and approval. Not every business will qualify. Costs, terms and timing vary.
Before you sign, you’ll receive the written cost disclosure your state requires. In some states, including California and New York, it includes an estimated annual percentage rate (APR) for comparison.
Examples, amounts and figures shown on this site, including in the funding planner, are illustrative only and are not an offer or commitment to fund. Quotations from third parties are shown as general commentary and do not imply their endorsement of Velo.
3. Our Role as a Broker
Velo is a commercial financing broker, not a lender or funder. We work with a wide range of third-party lenders and funders to find financing for your business. The lender or funder you choose decides whether to approve your request, sets the terms and provides the funds. Velo may receive compensation from the lender or funder that provides your financing. Where state law requires, that compensation is shown in the disclosure you receive before you sign.
4. Our Products
The financing described on the site is summarized in the disclosures that appear at the bottom of every page. Our State Disclosures & Licenses page has the complete list.
Velo Capital Funding is a commercial financing broker, not a lender. Financing is provided by third-party lenders and funders, subject to their approval. Terms vary. Velo works with a wide range of lenders and funders to find a funding solution for your business and may receive compensation from the lender or funder that provides your financing.
Financing options available through Velo include same-day funding, lines of credit, term loans, equipment financing, SBA loans, invoice factoring and home equity lines of credit. For every product, the lender or funder makes the decision, sets the terms and provides the funds. SBA loans are made by SBA-participating lenders.
Velo is not affiliated with or endorsed by the U.S. Small Business Administration or any government agency.
5. Not Advice
Information on the site is general. It isn’t financial, legal, tax or accounting advice, and it doesn’t take your business’s situation into account. Please talk to your own advisers before you make a financing decision.
6. Information You Give Us
When you use a form, book a call or apply, you agree that:
- the information you provide is true, complete and yours to share, or you’re authorized to share it;
- the financing you’re asking about is for business purposes only;
- you won’t submit another person’s or business’s information without their permission;
- we may use your information as described in our Privacy Policy.
Our application asks you to agree to receive disclosures and documents electronically and to sign electronically, as described in our E-Sign Consent.
7. Calls, Texts and Email
We’ll contact you about a request you make. Calls and texts about offers and other marketing need your separate consent, which you give only by checking the optional box on our forms. That consent isn’t required to book a call, apply or get funding, and these Terms don’t give it for you. Our SMS Terms explain how our texts work and how to opt out.
8. Booking a Call
When you book a call online, our scheduling provider creates the calendar invitation and sends your confirmation. You can reschedule or cancel with the links in that confirmation, or by emailing info@vcfus.com. A call with an advisor is a conversation about your options. It isn’t an application or an offer of financing, and booking one doesn’t involve a credit check.
9. Referrals
If someone referred you to Velo, they are independent of Velo. They can’t approve funding, set terms or make promises for Velo or for any lender or funder. If anyone asks you for an upfront fee to get financing through Velo, email info@vcfus.com.
10. Our Name, Logo and Content
The Velo Capital Funding name, the hexagon logo and the site’s text, design and code belong to Velo or its licensors. You may view, print and share pages from the site for your own business use. You may not copy, change or reuse our name, logo or content for any other purpose, including in advertising or marketing, without our written permission.
11. Acceptable Use
Please don’t:
- use the site for anything unlawful or misleading;
- scrape, crawl or copy the site with automated tools, or probe, scan or test its security;
- interfere with the site, its forms or its service providers, or try to get around any limits;
- submit false, automated or spam requests, or information you aren’t authorized to share;
- pretend to be Velo, an advisor or another person or business.
12. Other Websites and Services
The site links to other websites and uses services run by others, such as our scheduling and form-delivery providers. We aren’t responsible for their content, availability or practices, and their own terms apply.
13. Disclaimers
We work to keep the site accurate and available, but we provide it “as is” and “as available.” To the extent the law allows, we disclaim all warranties about the site, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the site will be uninterrupted or error-free.
14. Limitation of Liability
To the extent the law allows, Velo won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site. This section covers the site only. It doesn’t limit any right you have under a funding agreement or under a law that can’t be waived.
15. Indemnity
If you use the site in breach of these Terms or the law, you agree to cover Velo’s reasonable losses and costs that result, including reasonable attorneys’ fees, to the extent the law allows.
16. Governing Law and Disputes
These Terms govern your use of this website only. If you have a concern about the site, please email info@vcfus.com first so we can try to resolve it. These Terms are governed by applicable federal law and the laws of the state where Velo is organized, without regard to conflict-of-law rules. Nothing in these Terms changes the terms of any funding agreement, including how disputes under it are resolved, or the protections your state’s law gives you.
17. Accessibility
We want everyone to be able to use the site. If anything is hard to use, see our Accessibility statement or email info@vcfus.com, and we’ll help you another way.
18. Changes to These Terms
We may update these Terms. The date and version at the top of this page show when they last changed. Changes apply from that date to your later use of the site.
